Warranty

ABULIL X OFIR SRL ensures compliance with consumer rights as regulated in GEO 140/2021 on certain aspects relating to contracts for the sale of goods, OG 21/1992 on consumer protection, Law 296/2004 on the Consumer Code, as well as in other normative acts regulating consumer rights.

The legal warranty of conformity is 2 years from the date of delivery of the products.

The average lifespan of the product is 3 years.

In case of non-conformity, the consumer has the right, under the conditions of art. 11 of GEO no. 140/2021: a) to benefit from bringing the products into conformity; b) to benefit from a proportional price reduction; c) to obtain termination of the contract.

To bring the products into conformity, the consumer may choose between repair of the product and replacement, unless the chosen remedy would be impossible or, compared to the other available remedy, would impose disproportionate costs on the seller.

Repairs or replacements shall be carried out free of charge and within a reasonable period which may not exceed 15 calendar days from the moment the seller was informed by the consumer of the non-conformity.

The consumer benefits from the replacement of products if their non-conformity is found shortly after delivery, without exceeding 30 calendar days.

The consumer has the right either to obtain a proportional price reduction in accordance with art. 13 of GEO 140/2021, or to obtain the termination of the sales contract in accordance with art. 14 of GEO 140/2021, in any of the following cases: a) the seller has not completed the repair or replacement or, as the case may be, has not completed the repair or replacement in accordance with the provisions of art. 12 para. (2)-(4) of GEO 140/2021 or the seller has refused to bring the products into conformity in accordance with the provisions of art. 11 para. (3) of GEO 140/2021; b) a non-conformity is found, despite the seller's efforts to remedy it; c) the non-conformity is of such seriousness that it justifies a price reduction or the right to immediate termination of the sales contract; d) the seller has declared that he will not bring the goods into conformity within a reasonable time or without significant inconvenience to the consumer or this is clear from the circumstances of the case.

The consumer does not have the right to obtain termination of the contract if the lack of conformity is minor. The burden of proof regarding the minor nature of the lack of conformity lies with the seller.

The warranty does not cover products damaged as a result of failure to comply with the instructions for use, improper use, accidents of any kind or due to other causes unrelated to material or manufacturing defects.

To benefit from the guarantee, the consumer will present the guarantee certificate accompanied by the original tax receipt or, as the case may be, the tax invoice.
